LAWA settles Ontario cargo lawsuit, passes fiscal budget

A suit that pitted a developer wanting to build 1 million square feet of space for air cargo shippers at Ontario International Airport against the city of Los Angeles has been settled.

A 40-year lease between Los Angeles World Airports, which owns and operates Ontario airport, and Aero Ontario RFP LLC will be terminated. The city of Los Angeles agreed to pay Aero Ontario $1.66 million and the suit will be dropped with prejudice, meaning the developer won't be allowed to refile its lawsuit against LAWA, according to the LA city attorney.

The action was announced the settlement at the beginning of Monday's Board of Airport Commissioners meeting.

Commissioners also approved the airport's next fiscal year budget at the same meeting.

Starting in 2002, Aero Ontario, affiliated with Annapolis, Md.-based Aeroterm, began developing its plan to build an air cargo hub on 95 acres at Ontario airport, eventually signing a 40-year lease with the city of Los Angeles' agency in 2008. Company officials said the hub could eventually employ about 850 people. Aeroterm paid $1.5 million to Los Angeles World Airports at the time it signed the lease and paid monthly rent for land and hangar space.

The company had expected to finish the first of five phases by late 2009, but construction never started.

In its suit, Aeroterm had claimed it was under the impression that Los Angeles World Airports would be a partner in marketing its project to prospective cargo tenants based on language in its lease. It wasn't, and instead Los Angeles World Airports focused on bolstering cargo at Los Angeles International Airport instead, the company claimed.

It wasn't the first time LAWA had been accused of focusing its attention on LAX rather than its Inland airport

Passenger traffic at the airport has slowed severely in the past few years, dropping from 7.2 million travelers in 2007 to 4.8 million last year.

Officials with the city of Ontario and San Bernardino County have been attempting to regain management control of Ontario airport, claiming LAWA had not done enough to encourage airlines to do business at the airport since the cost per passenger there remained among the highest.

That cost is expected to be $12.95 per enplaned passenger starting July 1, versus earlier estimates that had it exceeding $14, based on flat passenger traffic and further cutting of expenses at the airport, according to LAWA staff.

Insurance: Do your vendors meet the necessary insurance coverage of your organization? Training: What career and skill development programs does the vendor have as part of their program? How does the facility operations team hone its skill in a live data center environment? Methodology: This is one of the biggest. How does a vendor effectively wrap all of the components of a successful critical facility operation into a succinct process that becomes the company’s doctrine? Quality Assurance/Quality Control/Quality Improvement: What is the vendors QA/QC/QI plan in regards to the review, creation, and constant adjustment to operations procedures (SOPs, MOPs, EOPs, etc)? Management Systems Integration: Assuming the client has a current maintenance management system, how would a vendor work with or integrate its preferred systems with the client’s existing system? Key Performance Indicators: How does the vendor measure performance? What method and how frequently does the vendor assess client satisfaction? Staff Determination: How does the vendor assess and determine staff levels in both number and technical capability?
